GENERAL TERMS & CONDITIONS
1 - Binding Agreement
These Terms & Conditions constitute a legally binding agreement between the Client (“Client”) and aleVSham Travel Collection and/or its authorized operating partners in Sri Lanka.
By confirming a booking, the Client acknowledges having read, understood, and accepted these Terms & Conditions in full.
2 - Booking & Payment Terms
A booking shall be deemed confirmed only upon:
- receipt of the required deposit; and
- issuance of written confirmation by the Company.
A standard deposit of 30% to 40% of the total tour cost is required unless otherwise specified.
The balance payment must be received no later than 30 to 45 days prior to arrival.
For peak seasons, restricted regions, high-demand festivals, luxury properties, special events, or journeys requiring special permits, full advance payment may be required.
All payments must be made through approved banking channels. Bank charges, currency conversion fees, transfer fees, and transaction costs shall be borne by the Client.
3 - Pricing & Adjustments
Prices are based on prevailing government taxes, supplier tariffs, exchange rates, transportation costs, and statutory levies applicable in Sri Lanka and destination countries at the time of quotation.
In the event of substantial changes in taxes, exchange rates, fuel prices, supplier rates, or governmental regulations beyond the Company’s reasonable control, the Company reserves the right to revise prices prior to receipt of full payment.
4 - Travel Insurance
Comprehensive travel insurance is strongly recommended and may be mandatory for certain journeys.
Insurance coverage should include:
- medical expenses
- emergency evacuation
- personal liability
- trip cancellation and interruption
- loss of baggage and personal belongings
The Company shall not be liable for losses arising from inadequate or absent insurance coverage.
5 - Health & Fitness
Certain journeys may involve remote areas, mountainous terrain, high altitudes, or physically demanding activities.
The Client is solely responsible for ensuring medical fitness prior to travel and agrees that the Company shall not be liable for health-related incidents, injuries, or complications arising during the journey.
6 - Role of the Company
aleVSham Travel Collection acts as a travel organizer, facilitator, and coordinator between the Client and independent third-party service providers, including airlines, hotels, transport operators, guides, excursion providers, and other suppliers.
The Company does not own, manage, or control such third-party service providers unless explicitly stated.
7 - Limitation of Liability
To the maximum extent permitted under the laws of Sri Lanka, the Company shall not be liable for:
- personal injury, illness, accident, or death
- loss, theft, or damage of baggage or personal property
- delays, cancellations, missed connections, or schedule changes
- weather conditions or natural disasters
- force majeure events
- political unrest, strikes, civil disturbances, or governmental actions
- acts or omissions of airlines, hotels, transport operators, or other third-party suppliers
8 - Force Majeure
Force majeure includes, but is not limited to:
- natural disasters
- pandemics or public health emergencies
- acts of God
- war, terrorism, or civil unrest
- government restrictions or border closures
- strikes or labor disputes
- adverse weather conditions
- road closures or transport disruptions
Under such circumstances, the Company shall not be held liable for non-performance, delays, or itinerary modifications caused by events beyond its reasonable control.
9 - Itinerary Changes
The Company reserves the right to alter itineraries, accommodations, transportation, or schedules where reasonably necessary due to operational requirements, safety considerations, weather conditions, or circumstances beyond the Company’s control.
Reasonable alternatives shall be offered whenever possible.
10 - Client Responsibility
Clients are responsible for:
- ensuring passport validity and required visas
- compliance with immigration and customs regulations
- carrying required travel documents
- respecting local laws, customs, religious sites, and cultural norms
The Company shall not be responsible for denied boarding, visa refusals, immigration issues, or penalties resulting from the Client’s failure to comply with legal requirements.
11 - Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.
Any disputes arising from bookings, payments, services, or interpretation of these Terms & Conditions shall be subject to the exclusive jurisdiction of the competent courts of Sri Lanka.
